This workshop is focused on Dispute Boards (DBs) / International and multinational practice with binding decisions, and is designed for those new to the DB process, interested in serving on DBs, and those implementing DBs for the first time.
Explore the basic tenets of the Dispute Board (DB) process:
- History and background of Dispute Boards and the DRBF
- Introduction to DBs
- Selection and appointment of DB members
- Site visits and meetings
- Informal Assistance and Advisory Opinions
- Claims, Disputes, Referrals, Decisions, and Enforcement
- Effectiveness of DBs
Workshop Trainers:
 Simon Fegen is based near Bath, United Kingdom, and specialises in the dispute avoidance and dispute resolution arena in the construction industry. He is a Professional Member of the Royal Institution of Chartered Surveyors, a Fellow of the Association of Arbitrators (Southern Africa) and a CEDR Accredited Mediator. His professional experience spans over 30 years and a variety of projects, including energy, water treatment plants and pipelines, highways, OPRC and airport terminal buildings, in various locations in Africa, Asia and Europe. Simon is a strong proponent of dispute avoidance through sound contract administration and supports the use of Dispute Boards; he currently serves on 2 standing dispute boards in Africa. Simon is involved with various training programmes on dispute avoidance and contract administration; and is currently the Director of Training for the Dispute Resolution Board Foundation (DRBF) Region 2.
 Julie Forsyth is an English solicitor, an arbitrator and an adjudicator with over 30 years as a specialist construction lawyer. Her practice focuses on the construction, engineering and energy sectors. In her role as counsel, she has worked with Dispute Boards on a variety of projects and is a strong advocate of their use. In the UK, Julie is a partner at Gunnercooke LLP and acts as solicitor for a variety of construction-related clients, and for banks providing development funding. Julie is a qualified arbitrator and has been a Fellow of the Chartered Institute of Arbitrators for 24 years and is also an Alternative Dispute Resolution Official at the Centre for Effective Dispute Resolution (CEDR) in London. She is Honorary Secretary of the Society of Construction Arbitrators. Julie is fluent in French and is Of Counsel at an established international arbitration law firm in Paris. She previously lived in South-West France for 10 years where she ran her own consultancy business, providing legal and business advice to international companies in the oil and energy, aeronautic and engineering sectors. Julie is based in the UK with her office in London.
 Aisha Nadar has been actively involved for over 30 years in all phases of the negotiation and implementation of large-scale cross-border infrastructure and defense programs. Her procurement and international contract management experience includes holding senior level positions in the US, the Middle East and Europe. She regularly advises clients on strategic procurement planning, contract drafting, contract management and dispute resolution and acts as arbitrator, mediator and dispute board member and has experience of ICC, LCIA, SCC, DIAC, AAA, UNCITRAL and FIDIC rules. Aisha has carried out assignments related to dispute resolution for organizations such as the World Bank, USAID and US DoD and is a regularly invited speaker at universities and specialized conferences on construction contracts and dispute resolution. Aisha is a member of FIDIC’s Executive Committee, the Chair of FIDIC’s Procurement Policy Sub-Committee, is listed on FIDIC President’s List of Accredited Adjudicators and served as one of the principal drafters of the updates of the FIDIC 1999 Suite. She is an officer of the International Construction Projects Committee of the International Bar Association and has previously served as a member of the Standing Committee of ICC International Centre for ADR. Aisha holds a BS Electrical Engineering from University of Nebraska, an MBA from University of Texas-Austin and an LL.M. in International Commercial Dispute Resolution from Queen Mary, University of London and completed the CIArb Diploma Course in International Commercial Arbitration, Oxford in 2005.
 Lindy Patterson is a Barrister with 39 Essex Chamber, London. She specialises in arbitration and adjudication, both internationally and within the UK. She is recognised as a leading construction and energy disputes specialist. She has extensive experience as counsel for clients in these sectors. As senior partner in a major commercial law firm before joining 39 Essex Chambers, she represented clients in large scale complex disputes in major infrastructure, energy and oil, and gas projects. She is President of Region 2 of the Dispute Resolution Board Foundation (DRBF); is on the FIDIC President’s List of International Adjudicators; and serves on the following panels: TeCSA Adjudicators; Transport for London Conflict Avoidance Panel and RICS (Scotland).
 Marcela Radovic is an attorney with more than 18 years of experience in contractual and claim management in construction industry in Chile and other countries in Latin America, focusing mainly in the mining, energy, retail and public infrastructure sectors. She is Founder and Director of Chilean Society of Construction Law and has earned a master’s degree in Regulation at London School of Economics University. Marcela is also a Professional Coach and Candidate for a Master's Degree in Coaching and Leadership from Barcelona University. Concerning her teaching experience, Marcela is Professor of “Magister de la Construcción” of the Engineer Faculty of Pontificia Universidad Católica de Chile, Professor of Universidad de Los Andes in Construction Law and Professor of Universidad de Talca in Construction Law. She has been a member of Dispute Resolution Board Foundation since 2009 and serves as the DRBF's Representative for Chile. She has also been a member of International Bar Association since 2014.
